As an artist you have to make decisions about the work you create and determine what you want to say, how you want to say it. At the same time, you need to make another key decision: SHOULD you say it? Is it right? Is it fair? Is it responsible? Is it ethical? Is it legal?
These are things that a practicing artist/art professional have to consider in their work.

A Usual Suspect: Jeff Koons
Jeff Koons is an American contemporary artist noted for his use of kitsch imagery,
especially in oversized works. Koons is known as an appropriation artist — he uses pre-existing images to comment on contemporary culture. His work is considered "contemporary" and for our purposes we can classify it into the genre of both "Contemporary" art and "Pop Art" (which you are familiar with already). Mr. Koons has been sued several times for copyright infringement. Take a look at some of the works on his website and you will start to see why....
